Will a victim be required to make a report to the OSC before commencing statutory tort proceedings in Court?
No, victims will be entitled to seek relief from the Court under the statutory torts, without first submitting a report to the OSC.
Can a Court hearing a statutory tort claim change an OSC decision?
No. A Court hearing a statutory tort claim cannot cancel or change a direction issued by the OSC.
However, the OSC may take the Court's findings into account when exercising its powers under OSRAA.
